1. Who you are buying from
You are buying from Shakespears Desserts. Shakespears Desserts is a trading name of Jolsa Curry House Limited, company number 16754544, registered in England and Wales. Registered office: 2 Hallgate, Chorley, England, PR7 1XA. Kitchen: 2 Hall Gate, Astley Village, Chorley, PR7 1XA.
Online ordering is provided to us by SERVD, a service run by SwitcherMate Ltd, a UK company, which is not the seller.
2. Ordering and acceptance
You order at order.shakespears.co.uk. Placing an order is an offer to buy. Your order is accepted when we confirm it. Until then there is no contract.
If we cannot make all or part of your order, we will tell you, and you will not pay for anything you do not get.
Please check your order, delivery address and phone number before you pay. We use the phone number you give to reach you about your order.
3. Prices and payment
Prices are shown in pounds and include VAT where applicable. The delivery charge is shown separately before you pay. You are never charged anything you were not shown.
You can pay online when you order, by card, Apple Pay or Google Pay. Online payments are processed by Stripe and we never see your full card number. For delivery you can also pay the driver in cash, and for collection you can pay when you pick up.
4. Delivery area and times
We deliver, and you can also collect your order from our kitchen at 2 Hall Gate, Astley Village, Chorley, PR7 1XA. There is no seating.
We deliver within 3.5 miles of our kitchen. The minimum order is £10. Delivery costs £2.99 and is free on orders over £30.
We are open Monday, Wednesday, Thursday and Sunday from 5pm to 10pm, and Friday and Saturday from 5pm to 10:30pm. We are closed on Tuesdays.
Delivery times are estimates, not guarantees. Weather, traffic and how busy the kitchen is can all affect them. Our Delivery Policy has the detail.
5. Allergens
Our kitchen handles nuts, dairy, gluten and eggs, so we cannot guarantee any dish is free of them.
If you have an allergy or intolerance, ask us before you order. Call or WhatsApp 07481 357801. Do not rely on the menu alone.
6. Promotional codes
A code applies only on the terms shown with it, such as a minimum spend, an end date or new customers only. One code per order. Codes cannot be combined, have no cash value, and we may withdraw a code at any time.
7. Cancellations and refunds
Food is made to order and goes off quickly, so the 14-day right to change your mind that applies to many online purchases does not apply to it (Consumer Contracts Regulations 2013, regulation 28). You can cancel only before the kitchen starts preparing your order.
Your food must be as described and of satisfactory quality (Consumer Rights Act 2015). If anything is missing, wrong or not right, tell us and we will put it right.

8. Our responsibility to you
If we break these terms, we are responsible for loss or damage you suffer that was a foreseeable result of our breach. We are not responsible for loss that was not foreseeable, or for business losses.
We are not responsible for delays or failures caused by things outside our control, such as severe weather or road closures, but we will tell you as soon as we can and you will not pay for anything you do not get.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.
9. Offer texts
If you order online, we may occasionally text you about our offers. Every text has a way to opt out, and our Privacy Policy explains how it works.
10. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you live in Scotland or Northern Ireland you can also bring a claim in your local courts.
